ℹ️ Compliance Position:Hairsncares does not claim to be "CDSCO-approved" as a platform. Rather, all pharmaceutical products sold through Hairsncares are sourced from CDSCO-regulated manufacturers and distributed through licensed supply chains. Our processes are designed to be compliance-aligned with the Drugs & Cosmetics Act, 1940 and Rules, 1945.
1. Our Compliance Position
Hairsncares operates as an online pharmacy and healthcare services platform. Our compliance framework covers:
- Pharmaceutical Sale Compliance:All drug products are sold in accordance with the Drugs & Cosmetics Act, 1940 and Rules, 1945, under a valid retail pharmacy licence.
- Prescription Management: Schedule H, H1, and X products are dispensed only against valid prescriptions from Registered Medical Practitioners (RMPs) — see Prescription Policy.
- Telemedicine Compliance: Teleconsultation services operate under the Telemedicine Practice Guidelines, India, 2020 issued by the Board of Governors, MCI.
- Data Protection: Personal and health data is handled in compliance with the Digital Personal Data Protection Act, 2023 — see Privacy Policy.
- Consumer Protection: eCommerce operations comply with the Consumer Protection (e-Commerce) Rules, 2020.
📋 We do not use the phrase "CDSCO-approved platform" because CDSCO approves drug products and manufacturing processes — it does not certify ecommerce platforms. Our pharma products are sourced from CDSCO-regulated supply chains. This is an important distinction.
2. Product Sourcing & Verification
All pharmaceutical products listed on Hairsncares are sourced from:
- Licensed manufacturers holding valid CDSCO manufacturing licences (Form 28/28-B as applicable)
- Authorised distributors and C&F (Carrying & Forwarding) agents of the respective manufacturers
- Wholesalers holding valid Drug Licence Form 20-B / 21-B
We maintain purchase records, invoices, batch numbers, and manufacturer certificates of analysis for all pharma products. These are available for inspection by regulatory authorities upon request.
New Product Onboarding Checks:
- Verify manufacturer's CDSCO drug approval / registration
- Confirm applicable Schedule classification (H/H1/X/OTC)
- Validate product labeling includes all mandatory information per Rule 96 of Drugs & Cosmetics Rules
- Confirm distributor holds valid wholesale drug licence
- Check for any CDSCO alerts, drug recall notices, or market withdrawal orders
3. Rx Sale Restrictions
The following restrictions apply to all prescription medicine sales on the platform:
- Schedule H products: dispensed only against valid prescription from a RMP. Display "Rx" symbol and mandatory warning text on product listing.
- Schedule H1 products: dispensed only against valid prescription, with enhanced monitoring — prescriber NMC number verified, prescription cross-referenced.
- Schedule X: not routinely sold; sale subject to additional regulatory requirements and shall not be processed without explicit compliance officer approval.
- All Rx transactions are logged with prescription reference, prescriber details, patient details, and product details per pharmacy record-keeping requirements.
See: Prescription Policy
4. Labelling & Expiry Checks
Before products are dispatched, our operations team performs the following quality checks:
- Expiry date check — products with less than 30% shelf life remaining are not dispatched
- Labeling integrity check — mandatory Schedule declaration, "Not to be sold by retail without prescription" label, generic name, batch number, manufacture and expiry date, manufacturer address, price as per MRP
- Tamper-evident seal check — products with compromised seals are not dispatched and are quarantined
- Cold-chain products: temperature-sensitive products are stored and dispatched per manufacturer cold-chain specifications
⚠️ If you receive a product with a compromised seal, incorrect labeling, or approaching/past expiry, do not use it. Contact quality@hairsncares.com with photos for immediate investigation and replacement.
5. Batch Numbers & Invoice Handling
Every order dispatch includes:
- Tax invoice with HSN code, GSTIN, product details, batch number, and MRP
- Batch number recorded against every pharma product order in our system
- In the event of a product recall by the manufacturer or CDSCO, we will contact affected customers using batch records
- Customers are requested to retain invoices for Rx products for their personal medical records
6. Storage & Shipping Responsibility
Hairsncares is responsible for product integrity from our warehouse to delivery. Post-delivery, responsibility transfers to the customer. Users are advised to:
- Store products as directed on the label (temperature, light, humidity conditions)
- Not store medicines in bathrooms or near heat/humidity sources
- Keep child-proof packaging in original containers
- Dispose of expired or unused medicines responsibly — do not flush or burn; contact local pharmacies for drug disposal programmes
